Features: This book is based on the training materials used in a series of courses jointly organized by the Beijing office of the German Technical Cooperation Company (GTZ) Legal Cooperation Project and the Treaty and Law Department of the Ministry of Commerce of the People's Republic of China under the "Ministry of Commerce Economic Law Training and Consultation" cooperation project. It aims to introduce special legal mechanisms for regulating foreign trade to readers who have at least a basic legal foundation. Since 1997, the German Technical Cooperation Company (GTZ) has been collaborating with the Ministry of Commerce of the People's Republic of China (MOFCOM) to promote the development of sound and predictable legal systems primarily related to commercial transactions, foreign trade, and investment. This book includes materials that have been successfully used in several China and Germany foreign trade law courses. It not only systematically introduces relevant Chinese laws but also covers the organization and provisions of the World Trade Organization (WTO), as its importance to China's foreign trade has been growing since China's accession to the WTO. The appendix introduces the common trade policy of the European Union, the largest member of the WTO, followed by several brief cases and solutions based on Chinese law. These solutions are primarily constructed according to the equity method, which plays a dominant role in German legal analysis. This book serves as a valuable guide not only for legal practitioners and officials in China and Germany but also for scholars and students. The other volumes in this series will use comparative legal case analysis between Chinese and German law and focus on other important private law areas, such as contract law, intellectual property law, and security law.
