Intellectual Property Law Tutorial

Author: Fei Anling
Publisher:
Publishing Date: 2003-07-01
Features: This book outlines the basic concepts, fundamental knowledge, and core theories of intellectual property law, explaining the key, challenging, and controversial aspects of the discipline. It provides a detailed account of the fundamental content of China's intellectual property legal system, summarizes the basic framework of the international intellectual property system, and offers a brief comparison of China's intellectual property system with those of major intellectual property countries such as the United States, Europe, and Japan, raising issues and proposing solutions. The book is structured in a "general-to-specific" format, divided into five parts to elaborate on the basic concepts, fundamental knowledge, core theories, and key, challenging, and controversial aspects of intellectual property law. Part I, "Introduction," serves as the general framework, primarily covering the significance of intellectual property, its legal characteristics, institutional value, its position within the private rights system, and international protection. The remaining four parts, based on the content of intellectual property law, discuss the Copyright Law, Patent Law, Trademark Law, and other intellectual property legal systems (Part V). The book employs a historical, comparative, and theory-practice integrated approach to systematically, comprehensively, and deeply interpret the fundamental principles of intellectual property law. It does not merely explain "how the law is," but further questions "how the law should be." This distinguishes it from general textbooks that satisfy themselves with legal annotations alone, as it better stimulates critical thinking in readers. Moreover, it is not purely conceptual, but practical, offering feasible solutions to real-world problems. This book can serve as a teaching resource for faculty and students of civil and commercial law and intellectual property law at universities and colleges; as a training manual for officials in the national intellectual property administration system, science and technology administration system, and industrial and commercial administration system; as a training guide for intellectual property agents; and also as a reference for relevant researchers.
